Oy, lemme just start by saying I have 2 360s, one modded and one not (and a PS3 that's gathering dust).
The guy who sold me the modded 360 says that I can't use it on Live or it'll get my console banned (not the account?). So what I wanna know is will the Xbox get banned if I play original games? Do Microsoft detect your modded console or the fact that you're playing a pirate copy?
Anyone got any idea?

I'm pretty sure the system only checks itself once you log online so as long as you don't browse the shop or check for updates or whatever you're good.
but someone else correct me on this because i don't have a modded 360

Don't connect your modded 360 to the internet and you should be fine. Without using live... I wouldn't see the need for you to have it connected anyways.

They detect that its modded. And yeah if you connect to the internet Microsoft collects the data needed to tell.

Wanky. I was playing a game of Unreal Tournament 3 today on the modded 360. No problems. Although, I think Microsoft wouldn't notice right away, I'll probably get banned sooner or later.
I pretty much just use the modded 360 for trying out games that don't have demos and stealing games that aren't worth the money.
