I mean like some kind of open source program, it dosent have to be great, I recently got a new computer and lost my old one so no more 2003, i dont want to go find another one so dose anyone know where a good free little program for a is.

I was thinking of Gamemaker, beacuse I would like to make an action game, but I want RPG elements in it,

sphere or gamemaker can make rpg's and I'm pretty sure they're free, although much harder than rm2k3... there was another one but I forgot the name...

Actually, I was thinking more of a sidescrolling action game (not a platformer) then an RPG, so would Gamemaker be good for that, also where can I get gamemaker online

Yeah, Game Maker would work well. You should probably try googling it before asking though.

Nessiah mentioned Scirra Construct, which is an open source game maker under the GNU license. It's a newer one, so it doesn't have a big tutorial or resource base, but I rather like it more than game maker. Kind of reminiscent of rm2k, in my opinion. Anyway, game maker is fine, too.

Construct looks like click and create : source except the demos run a lot smoother than any game maker or click and create / multimedia fusion I have ever seen so I'd also take a look at it

construct is more powerful than game maker lite, and i can see it be a lot quicker and easier to use once you get used to it. unfortuneatly i cant be bothered to learn how to use it as i really dont make much game-wise any more but it did look pretty good when i tried it out

Construct is still in beta, but yes it is significantly more powerful than GameMaker and since it is using DirectX for rendering it doesn't suffer from such tight graphical and effect limitations. It is really quite intuitive if you've already used GameMaker as well.
