Help i might be getting evicted from an illegal sublease (Read 1252 times)

i was late paying the rent to the person whose name was on the lease, but they told me it was fully paid wednesday and we prepaid them for the remaining months of how long we were staying. now last night the owner comes to deliver an eviction notice because $460 of the rent isn't paid (out of about $850 i think - utilities and late fee were a separate thing, but we paid those yesterday morning and we should be square with the person whose name is on the lease), and he found out we were here illegally (we covered pretty well though). now this afternoon he wants to meet with us because apparently the only options are to sign over the entire lease through august to us (we were only supposed to be here through May) or we get thrown out in 2 days, since he delivered the notice yesterday night.

it's not THAT horrible because this place was the only way we could've stayed for the semester without signing over a full lease anyhow, but if we sign over the lease the original tenants are under no obligation whatsoever to continue the original deal (we move out in may and they continue paying their own rent), and we can't stay here without leasing through august.

what are our options here. is there any way you can think of that we can get out of paying the summer rent other than finding someone to lease to again? we do still have some leverage in that we can just move out in two days and the tenants are stuck with the rent anyhow, but then we lose the rent we've already paid for this month and we'd have to find someplace to move and we have a lot of stuff.

I'm kinda confused why couldn't you get a legal sublease originally? Goodluck though, hopefully the owner is reasonable.

because we only wanted to stay for three months and didn't want to have to lease over the summer.

it turns out their dumb crackhead daughter forgot to pay the second half of the rent, which is why we got an eviction notice and i think we're now locked into a lease for the summer.

Sounds like the landlord is a dick and is gonna try and squeeze you for money. There's no reason to pull this kinda crap so late in the lease other than trying to pull some scummy slumlord shit. Who knows, maybe if you let them know what's going on and pay them for a background check they won't care too much, but its probably unlikely if they're putting notes on your door saying that you staying there is illegal.

Check the tenants rights in your city and whip up a sublease agreement on the computer, you can probably get away with that if the law is on your side.

actually the landlord just wants us to transfer the lease, because we're illegal residents in the complex and that makes him liable. considering he could evict us (and he mentioned he could if we didn't take care of this situation), he seems pretty reasonable considering the mess we're in and just wants to be paid for the months we're there and the transfer fee, which the actual tenants are responsible for. he really seems to just want our names on the actual resident paper, which unfortunately comes with us being responsible for the summer rent (and the complex doesn't allow for us to just lease out two months from them).

the rent for this month has been paid though so the worst he can give us is a 7 day eviction notice.

This is precisely the time you get a sublease man. We are the main tenants on the lease but over the summer it'll be a whole new mix of guys subletting from us. They'll become legally responsible to pay some portion to us (while we still pay rent). I can't imagine many landlords would be against a sublease if they are getting all their rent and the unit isn't empty ever.

Also I figured he put it in AM for privacy purposes.

Have you looked around for another apartment just incase you cant think of a way to stay? It sucks you will lose this months rent if your evicted but since your technically there illegally then unfortunatly thats the price you will have to pay. I dont know too much about the law concerning this matter so cant offer any sound advice but I would personally start looking for a new place immediately, sorry.

I didn't know most landlords even care about this kinda thing.  I'm renting out my living room floor right now and my landlord has come to collect rent while my friend was BUNDLED UP and he never said anything.  Shit, in my first apartment when I moved out of the dorms I had like 12 people sleeping at random places at all times!

But then again this is Tennessee - where even in apartments your nearest neighbor is 7 miles away down a dirt path and landlords usually live in shacks out in the woods.
